§ 2 Description of Services

TruckerGo is a mobile application for professional truck drivers and offers the following functions:

Free of charge: truck parking areas on an interactive map, including the display of one's own location while the vehicle is stationary; reporting parking occupancy; suggesting and confirming parking areas and filling stations; reporting errors at parking areas and filling stations; reporting road warnings and particular features of parking areas; fuel prices (DE, AT, FR, ES, IT only); one vehicle profile.

TruckerGo Premium (paid): in-app navigation with truck routing and voice guidance, including warnings of road bans, restrictions (height, weight, through traffic) and hazards reported by drivers during the journey as well as roadworks and traffic disruptions along the calculated route (see 2.0); searching for places and addresses; the map following one's own location while driving; waypoints, toll avoidance, filters, favourites, viewing the parking occupancy reported by other drivers, the map layer showing road bans and restrictions, toll stations as well as road warnings on the map, ratings and comments, multiple vehicle profiles, and an ad-free experience. All users collect points, even without Premium; the daily limits apply to everyone. Points can only be redeemed from 4 paid Premium months. Not counted are the free trial week, months redeemed with points, refunded payments and access via a fleet or permanently granted Premium; the points are kept in these cases. Anyone can enter an invitation code.

Fleet accounts (B2B): group access for companies (see § 6a)

2.0 Warnings during the journey. The warning of a road ban, a restriction or a hazard reported by drivers arises from the calculated route. It is therefore part of every navigation — including during the trial (§ 6) and with fleet access (§ 6a) — and is neither restricted within a navigation nor made dependent on a further paid tier. Without a calculated route there are no warnings along the way. The map layer that allows restrictions and hazards to be viewed on the map without a journey in progress is part of Premium.

Reporting parking occupancy is free of charge; viewing the reports of other drivers is part of Premium. Where occupancy is not displayed, the App expressly indicates that information is being withheld — a parking area without an indication is not to be understood as “free” or “no report available”.

The scope of the free functions may be adjusted at any time; paid functions are guaranteed for the duration of the subscription.

2.1 Counting of new routes. Where these Terms provide for a limit on new routes (trial, § 6; monthly limit, § 2.3), the following applies:

Only the deliberate entry of a new journey is counted — that is, selecting a destination from the search or triggering the calculation via the button provided for this purpose.

In particular, the following are not counted:

If it cannot be determined beyond doubt whether a calculation is to be counted, it is not counted. Navigation that has already started is not interrupted when the limit is reached; recalculations during an ongoing journey also remain possible, up to the upper limit under § 2.2 a).

2.2 Fair use. To prevent misuse, the following limits per user account also apply with Premium, during the trial and with fleet access (calendar day and calendar month each according to German time):

Once a limit is reached, the App indicates this outside an ongoing navigation; use is possible again from the following calendar day or calendar month. For the trial, the daily limit under § 6 applies in addition.

2.3 Monthly navigation limit. Navigation is limited per user account to 200 hours or 17,500 km per calendar month (German time), whichever is reached first. The driving time and distance of newly calculated routes are counted; for time, at least the actual navigation time. Once the limit is reached, the App indicates this when a new route is started; navigation already in progress is not interrupted. New routes are possible again from the following calendar month. The map always remains available.

The data displayed come predominantly from public and official sources and from reports by the user community. They may be incomplete or out of date; no guarantee of completeness is given. Fuel prices are available exclusively for Germany, Austria, France, Spain and Italy — in other countries, filling stations are displayed without price information.

§ 3 Registration and User Account

Use of the App requires the creation of a free user account. On registration, the user warrants that:

One user account is permitted per person. In the event of misuse, JG Software is entitled to block or delete the account without prior notice.

§ 4 User Obligations and Prohibited Content

The user undertakes to use the App exclusively for its intended purpose and in accordance with applicable law. In particular, the following is prohibited:

In the event of violations, the account may be blocked. In the event of serious violations, JG Software reserves the right to take legal action.

§ 5 User Content (Community Contributions)

5.1 Scope. The App allows community content to be submitted: parking spot and filling station suggestions (including name and facilities), occupancy reports, ratings, comments and route warnings. This content is visible to other users. Error reports about parking areas and filling stations are not contributions for other users; they go to JG Software only.

5.2 Responsibility and grant of rights. The user is personally responsible for the accuracy and lawfulness of their contributions. They grant JG Software the non-exclusive, worldwide, royalty-free right to display, store and process the content within the App. By submitting content, they warrant that they hold the necessary rights and do not infringe any rights of third parties.

5.3 Prohibited content — zero tolerance. JG Software does not tolerate any objectionable content or abusive behaviour. In particular, it is prohibited to post content that

5.4 Reporting and blocking. In the App, any contribution can be reported and any author can be blocked. A blocked user is no longer displayed to the user who blocked them. Incoming reports are reviewed without undue delay.

5.5 Consequences of a violation. In the event of violations of clause 5.3, JG Software is entitled to remove the content concerned without prior notice and to warn the user, suspend them temporarily or permanently exclude them from use. The choice of measure depends on the severity and repetition of the violation. Instead of blocking the entire account, JG Software may also temporarily exclude the user from community functions — either only from writing comments and ratings as well as their own names for parking spots and filling stations, or from all contributions (including occupancy reports, parking spot and filling station suggestions and road warnings). Navigation and Premium remain unaffected; the user may still report content. Each measure is communicated to the user, stating the reason and duration.

5.5a Warnings for minor violations. In the case of minor violations — in particular under clause 5.3 letters a, e and f (insults, advertising, knowingly false information) — the user is warned. Each warning is communicated to them, stating the reason. After the third warning, the user account may be permanently blocked. The user may enquire at any time how many warnings exist in respect of their account.

5.5b Immediate blocking for serious violations. In the case of serious violations — in particular under clause 5.3 letters b and c (hatred and violence, content harmful to minors) and in the case of criminal offences — the account is blocked immediately and without prior warning.

5.6 Moderation. JG Software is entitled to review, moderate or remove content even independently of a report. There is no entitlement to publication or retention of a contribution.

5.7 Contact. Users should send complaints and notices regarding content to info@truckergo.de. The contact details are also given in the legal notice (Impressum).

§ 6 Premium Subscription and Payments

Prices:
TruckerGo Premium costs €9.99 per month or €109.99 per year (final prices in Germany). The price shown by the App Store or Google Play before purchase is decisive; in other countries the store sets the price in the local currency.

Premium subscriptions are processed via the respective app store (Apple App Store / Google Play Store). The payment and subscription terms of Apple or Google, respectively, apply additionally. Payments are made directly to Apple or Google, not to JG Software.

Automatic renewal: The subscription is automatically renewed for the booked period at the price applicable at the time, unless it is cancelled at least 24 hours before the end of the current term.

Cancellation on iOS: Settings → tap your own name → Subscriptions → TruckerGo → Cancel subscription.
Cancellation on Android: Open subscriptions in Google Play (play.google.com/store/account/subscriptions) → TruckerGo → Cancel subscription.
The menu names are determined by Apple and Google and may change; their help pages are authoritative.

Free trial (7 days): Each user account can try the Premium functions free of charge for seven days once only. The trial is started by the user themselves and does not begin automatically upon registration. It ends automatically after seven days. During the trial, a daily limit of four calculations per calendar day (German time) applies to new route calculations; counting is as in § 2.1, so recalculations during the journey do not count, and navigation that has started is not interrupted. All other Premium functions are available during the trial; the limits under § 2.2 and § 2.3 also apply here. The daily limit may be adjusted in accordance with § 12; the applicable value is stated in the App as soon as it is reached. No payment obligation arises, and there is no automatic renewal and no charge; cancellation is therefore not required. After the trial ends, the free version of the App remains available unchanged. A Premium subscription can be purchased separately at any time. At the user's request, JG Software may extend the trial in individual cases by one week at a time; there is no entitlement to this. The extension is subject to the same conditions as the trial.

Subscriptions cannot be transferred to other accounts. The price applies per user account.

§ 6a Fleet Access for Businesses

6a.1 Subject matter. Fleet access is intended exclusively for entrepreneurs within the meaning of § 14 BGB (German Civil Code). JG Software provides the business with user accounts with Premium functions for the drivers it designates. The number of accounts at set-up and the price per driver are set out in the confirmation that the business receives upon set-up.

6a.2 Billing. Billing is per active driver account. The price per driver per month is the same for every fleet size; there is no volume discount and no minimum number of drivers. The price is set before launch and stated in the confirmation that the business receives upon set-up; as long as no price has been set, fleet access is not offered. Whether VAT is added is set out in the confirmation and the invoice. The basis for billing is the highest number of driver accounts existing at the same time in the billing month. An account counts from the day it is created. An account removed by the business remains usable until the end of the billing month and is charged for that month (clause 6a.8); if the business creates a new account in the same month, it takes the place of the removed one and is not counted in addition, provided that the old account has previously been marked for removal. The billing month is the calendar month. Billing takes place monthly in arrears: at the beginning of the following month, JG Software sends the business an invoice in text form to the e-mail address provided upon set-up. Payment is made by bank transfer to the account stated in the invoice. No direct debit takes place. The business can view the current status and the highest level reached so far in the current month at any time in the fleet management.

Different terms for an individual business, such as an individual fleet offer, may be agreed in a separate contract (individual contract) in text form. Unless the individual contract provides otherwise, these Terms apply.

6a.3 Payment term. Invoices are due for payment without deduction within 7 days of the invoice date.

6a.4 Default and reminders. If the business does not pay within the period under clause 6a.3, it is in default without further reminder (§ 286 Abs. 2 Nr. 1 BGB). JG Software will nevertheless send reminders:

For the duration of the default, JG Software may claim interest at the statutory rate (§ 288 Abs. 2 BGB) as well as the statutory lump sum under § 288 Abs. 5 BGB. The right to claim further damages remains unaffected.

6a.5 Blocking in the event of payment default — in stages. If the invoice has not been settled by the 14th day after the invoice date, JG Software is entitled to block access. Blocking takes place in two stages:

Navigation in progress at the time of blocking is not interrupted; it continues to the destination. The driver then receives an understandable notice of the reason for the blocking and of the contact person in their company — no technical error message and no blank display.

The payment obligation for the current billing month remains. Upon full settlement, the accounts are unblocked again without undue delay; the drivers’ data are retained during the blocking.

Blocking under this clause and termination under clause 6a.6 or 6a.9 do not affect payment claims that have already arisen. Invoices already issued remain due for payment in full.

6a.6 Termination. Fleet access runs for an indefinite period and may be terminated by either party with 14 days’ notice to the end of a billing month. There is no minimum term. The termination must be in text form and addressed to info@truckergo.de or to the address stated in the legal notice (Impressum).

6a.7 Effective date. Termination takes effect at the end of the billing month for which the notice period under clause 6a.6 has been observed. Upon taking effect, the Premium functions of the assigned accounts cease. The accounts themselves remain as free user accounts unless the respective driver requests their deletion; § 11 applies unchanged in this respect.

6a.8 Change in the number of accounts. The business creates driver accounts in the fleet management itself and removes them there. Removal takes effect at the end of the current billing month: until then the account remains usable and can be kept again in the fleet management; at the start of the following month it is blocked and deleted after 30 days. A change in the number of accounts is a specification within the existing contract and does not constitute a new conclusion of contract; no pro rata refund is made for the current month.

6a.9 Extraordinary termination. The right of either party to terminate for good cause remains unaffected.

6a.10 Change of prices. JG Software may change the prices for fleet access with six weeks’ notice to the end of a billing month. The change is communicated to the business no later than six weeks before it takes effect, in text form to the e-mail address provided upon set-up; the notification states the previous and the new price as well as the date on which it takes effect.

The business may terminate fleet access up to the day on which the price change takes effect. The notice period under clause 6a.6 does not apply in this respect; the termination takes effect on the day before the change takes effect. If the business does not terminate, the new price applies from the notified date. The notification expressly draws attention to the right of termination.

6a.11 Free trial week. Businesses may test fleet access once, free of charge, for seven days with up to ten driver accounts. The trial week creates no payment obligation and does not renew automatically; it ends automatically, after which the management area and the driver accounts are blocked. If no contract is concluded within 30 days of the end, the accounts are deleted; the business is notified in text form seven days beforehand. If an offer is accepted, the driver accounts are taken over; the month in which the trial week ends is charged pro rata by days from the day after it ends. Each business is entitled to the trial week only once; JG Software checks this by company name, e-mail domain and VAT ID. At the business's request, JG Software may extend the trial week in individual cases by one week at a time; there is no entitlement to this. The periods for blocking and deletion then start from the extended end.

§ 7 Right of Withdrawal

The statutory right of withdrawal applies only to consumers (Section 13 of the German Civil Code, BGB). Businesses (Section 14 BGB), for example with fleet access under § 6a, have no right of withdrawal. As Premium subscriptions are billed via Apple or Google, their respective withdrawal and refund policies apply. For refund requests, please contact Apple (reportaproblem.apple.com) or Google Play directly.

Insofar as JG Software is directly the contracting party of a consumer, there is a 14-day right of withdrawal. The right of withdrawal expires early if the user has expressly consented to performance of the contract beginning before the end of the withdrawal period and has confirmed their knowledge that they lose their right of withdrawal by giving this consent.

§ 8 Liability

8.1 Unlimited liability
JG Software is liable without limitation in cases of intent and gross negligence, injury to life, body or health, where a guarantee has been assumed, and under the Produkthaftungsgesetz (German Product Liability Act).

8.2 Liability for simple negligence
In cases of simple negligence, JG Software is liable only for breach of an essential contractual obligation — that is, an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely. In this case, liability is limited to the foreseeable damage typical for the contract.

8.3 Any further liability is excluded.

8.4 Information without guarantee

(1) Principle. The following information in TruckerGo consists of suggestions and aids. It is based on data from external providers, public authorities and other drivers, which may be inaccurate, incomplete or out of date. JG Software does not warrant that it is correct, complete or up to date. The signage on site, the traffic regulations and – where required – official permits are always authoritative. You remain solely responsible for driving your vehicle safely and in accordance with the regulations, including compliance with driving and rest times.

(2) Route and passability. The calculated route is a suggestion, not an assurance that the road may or can be driven with your vehicle. Height, width, length, weight and axle load restrictions are not recorded everywhere in the map data.

(3) Occupancy of parking spaces. Occupancy information consists of estimates or snapshots. A free space is not guaranteed.

(4) Warnings and traffic situation. Warnings about restrictions, road warnings from other drivers, notices of driving bans (e.g. Sunday and public holiday or holiday driving bans), roadworks, closures and congestion are incomplete and may appear late or not at all. The absence of a warning does not mean that the road is clear or permitted.

(5) Parking space information. Location, facilities, capacity, opening hours, costs and ratings of parking spaces come from open data sources, official sources and drivers. This also applies to information on suitability for heavy transports, whether it comes from official sources or from drivers’ votes. You must check on site whether a parking space is open and suitable for your vehicle.

(6) Arrival time. The displayed arrival time is an estimate. Breaks, driving and rest times, traffic and waiting times are not or only partly taken into account.

(7) Fuel prices. Fuel prices come from reports by public authorities and filling stations (e.g. the German Market Transparency Unit for Fuels). They may change at any time and differ from the price at the pump. The price at the filling station is authoritative.

(8) Liability. For damage resulting from any of the information mentioned in paragraphs 2 to 7 being incorrect, incomplete or out of date, JG Software is liable in accordance with clauses 8.1 and 8.2. Liability for intent and gross negligence, for injury to life, body or health, under a guarantee and under the Produkthaftungsgesetz (German Product Liability Act) remains unaffected.

§ 9 Data Protection

Personal data are processed on the basis of the applicable data protection provisions. Details of the type, scope, purpose and legal basis of the processing and of the rights of data subjects are set out in the Privacy Policy.

Where processing is based on consent, such consent is obtained separately and expressly; it may be withdrawn at any time with effect for the future. Consent is not given by agreeing to these Terms. The user receives advertising by email only if he or she has consented to it; important service messages (for example on security, the account, outages and changes to these Terms or to the Privacy Policy) are received regardless.

§ 10 Availability and Maintenance

JG Software endeavours to ensure the highest possible availability of the App but cannot guarantee 100% availability. Maintenance work is, where possible, carried out outside peak usage times and announced in advance. Outages due to force majeure, third-party service providers or technical problems do not give rise to any claim to compensation.

§ 11 Term and Termination of the User Account

The free user account can be deleted by the user at any time without notice in the App (Account → “Delete account”) or by contacting datenschutz@truckergo.de. Premium subscriptions must be cancelled separately via the App Store or Google Play.

JG Software reserves the right to block or permanently delete accounts without prior notice in the event of serious violations of these Terms.

§ 12 Amendments to the Terms

JG Software may amend these Terms, in particular in the event of changes in the legal situation, case law or the scope of services.

Material amendments require the express consent of the user. Consent is obtained in the App: the user is informed of the amendment and its essential content, is given access to the complete new version and actively consents. The time of consent is stored. Consent is not given by mere silence or by continued use.

The new version applies as soon as the App asks for consent. If the user does not consent, the user relationship ends at that time. The user cancels a running Premium subscription themselves in the App Store or on Google Play so that it does not renew. JG Software refunds the period already paid for that can no longer be used, pro rata by days, on request to info@truckergo.de; for purchases via Google Play the refund may be made via Google. The user can delete their account themselves at any time.

Non-material amendments — such as editorial corrections or the adaptation of the description of services to a scope of functions that has already changed — take effect without separate consent. They are documented traceably in the version archive.

§ 13 Applicable Law and Place of Jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict-of-laws rules of private international law. For consumers, the law of the EU Member State in which they have their habitual residence applies additionally, insofar as it contains mandatory consumer protection provisions.

The place of jurisdiction for merchants and for users without a general place of jurisdiction in Germany is the registered seat of JG Software.

§ 14 Final Provisions

Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by the legally permissible provision that comes closest to its economic purpose.

These Terms are concluded in the German language. These Terms are available in German and English. The German version is binding.
